1. IntroductionMahalaxmi Jewellers is a jewellery retail business operating from Masur, Umbraj Road, Tal-Karad, District Satara, Maharashtra – 415106.We may communicate with customers through conventional communication methods and digital communication channels, including telephone, SMS, WhatsApp Business, RCS for Business, email and other channels that may become available from time to time.Our digital communication channels may be used for legitimate business purposes such as responding to enquiries, providing product information, confirming customer requests, communicating order-related information, providing service updates, sharing appointment information, responding to customer support requests and, where legally permitted and appropriately consented to, communicating promotional or marketing information.Our use of WhatsApp and RCS is subject to the applicable policies, technical requirements, terms and restrictions imposed by the relevant platform providers. These Terms do not replace or override those third-party platform terms.
2. DefinitionsFor purposes of these Terms:“Business” means Mahalaxmi Jewellers.“Customer” or “User” means any individual who visits, contacts, communicates with, purchases from or otherwise interacts with Mahalaxmi Jewellers.“Services” means the jewellery products, customer assistance, enquiries, order-related services, communication services and other facilities offered by Mahalaxmi Jewellers.“Digital Communication Services” means communication through WhatsApp Business, RCS for Business, SMS, email, telephone, website forms or similar communication channels.“WhatsApp Business” means the WhatsApp Business services or WhatsApp Business Platform made available by Meta or its relevant affiliates and service providers.“RCS” means Rich Communication Services, including RCS for Business or related business messaging services.“Message” means any text, image, document, link, notification, promotional communication, service communication or other communication transmitted through an applicable communication channel.“Customer Information” means information supplied by a customer, including name, telephone number, email address, address, order information and other information reasonably necessary to provide our services.“Third-Party Service Provider” means an external company or platform that assists with communications, payments, technology, hosting, messaging, delivery, analytics or related business functions.
3. Acceptance of TermsBy using our services or communicating with Mahalaxmi Jewellers, you agree to comply with these Terms and all applicable laws and regulations.If you do not agree with these Terms, you should not use our digital services or request communications from us.Where a customer places an order or purchases jewellery from us, additional transaction-specific terms, invoices, quotations, product descriptions, warranties or applicable statutory requirements may also apply.If there is a conflict between these general Terms and a specific written transaction document issued by Mahalaxmi Jewellers, the specific transaction document may apply to the extent of that conflict.
4. Description of ServicesMahalaxmi Jewellers provides jewellery-related products and customer services. These may include, depending on availability:Display and sale of jewellery products;Product enquiries and quotations;Customer support;Order and purchase-related communication;Appointment or visit-related communication;Product availability information;Payment and transaction-related information;After-sales assistance;Customer feedback and service communication;WhatsApp Business communication;RCS communication;Promotional communication where permitted and where appropriate consent has been obtained.Product availability, pricing, designs, making charges, taxes, discounts and other commercial conditions may change from time to time.A communication sent to a customer does not necessarily constitute a binding offer to sell a particular product unless expressly stated as such.
5. EligibilityOur services are generally intended for individuals who are legally capable of entering into contracts under applicable Indian law.If you are below the age at which you can independently enter into a legally binding transaction, you should use our services only with the involvement and supervision of your parent or lawful guardian.We do not knowingly seek to collect unnecessary personal information from children.Customers are responsible for ensuring that the information supplied to Mahalaxmi Jewellers is accurate and belongs to them or that they are otherwise authorised to provide it.
6. Account RegistrationCertain digital services may require customers to provide identifying or contact information.You agree to provide accurate, complete and current information when interacting with Mahalaxmi Jewellers.Where an account, customer profile, communication preference or other record is created, you are responsible for ensuring that the information remains reasonably accurate.You must not impersonate another person, use another person’s telephone number without authorisation, provide misleading information or attempt to access another person’s account or customer information.Mahalaxmi Jewellers may refuse, suspend or discontinue a digital service where information appears fraudulent, misleading, unauthorised or inconsistent with applicable law or platform policies.
7. User ResponsibilitiesCustomers agree to use our services responsibly and lawfully.You must not:Provide false or misleading information;Impersonate another person or business;Use our communication channels for unlawful activities;Attempt to interfere with our systems;Send malware, malicious links or harmful files;Attempt unauthorised access to our systems;Use our messaging channels to harass employees or other persons;Abuse, threaten or intimidate our staff;Use automated systems to overload our communication channels;Submit another person’s personal information without lawful authority;Use our communication channels for fraudulent activities;Circumvent applicable messaging restrictions;Engage in activities that violate applicable Meta, WhatsApp, Google, RCS, telecom or other platform policies.We reserve the right to restrict communication access where necessary to protect customers, employees, systems or third parties.
8. Payment & Billing TermsWhere jewellery or other products are purchased, the applicable price, taxes, making charges, discounts, delivery charges and other transaction costs will be communicated to the customer as applicable.Customers are responsible for making payments through the payment method accepted by Mahalaxmi Jewellers.Any quotation or displayed price may be subject to applicable taxes, product specifications, making charges, wastage charges or other transaction-specific conditions.Where a third-party payment service is used, payment processing may be governed by that provider’s own terms and privacy policy.Mahalaxmi Jewellers does not request customers to disclose passwords, OTPs, PINs, CVVs or other confidential authentication information through ordinary business messaging.Customers should independently verify payment instructions before transferring money.
9. Subscription Renewal & TerminationMahalaxmi Jewellers does not ordinarily provide a consumer subscription service merely by virtue of purchasing jewellery.Where any subscription, recurring service, membership, digital service or recurring communication service is introduced in the future, its applicable price, renewal period, cancellation procedure and billing conditions will be communicated separately before the service is activated.Where a recurring arrangement is legally and technically supported, renewal will be subject to applicable consent, payment rules and law.Mahalaxmi Jewellers may discontinue a digital communication service, customer account or messaging facility where required for security, operational, legal or platform-compliance reasons.Customers may request cessation of promotional communications at any time.
10. Use of WhatsApp Official API & RCSMahalaxmi Jewellers may use official WhatsApp Business services and/or RCS for Business to communicate with customers.Such communication will be used only for legitimate business purposes and in accordance with applicable laws and the rules of the relevant platform.WhatsApp and Meta are independent third-party platforms. RCS for Business may involve Google, Jibe, telecommunications carriers and other authorised providers.Mahalaxmi Jewellers does not claim ownership of WhatsApp, Meta, Google, RCS or any associated trademarks.The use of these services does not imply that Mahalaxmi Jewellers is owned, endorsed or sponsored by Meta, WhatsApp, Google or any telecommunications carrier.Customers should rely only on official communication channels associated with Mahalaxmi Jewellers and should remain alert to fraudulent messages or impersonation attempts.
11. Message Delivery & Compliance PolicyMahalaxmi Jewellers is committed to responsible business messaging.We will endeavour to send messages only where there is an appropriate business relationship, customer request, lawful basis or applicable consent.Promotional communications will not knowingly be sent to customers who have opted out of receiving such communications.Customers may request that promotional communications stop by using the available opt-out mechanism or by contacting Mahalaxmi Jewellers.For RCS communication, customers may use an available “STOP”, opt-out or equivalent mechanism where supported. We will process reasonable opt-out requests promptly.Message delivery depends on third-party platforms, mobile networks, device compatibility, internet connectivity and other technical factors. Mahalaxmi Jewellers cannot guarantee delivery, read status or uninterrupted availability of every message.We will not knowingly use messaging services to send deceptive, fraudulent, unlawful, threatening, abusive or prohibited content.We may suspend messaging to a customer where continued communication could result in spam complaints, abuse, security risks or platform-policy violations.
12. Intellectual Property RightsAll original content created by Mahalaxmi Jewellers, including business text, photographs, graphics, designs, logos, product descriptions, website content and other materials, is owned by or lawfully used by Mahalaxmi Jewellers unless otherwise stated.Customers may not reproduce, modify, publish, distribute, sell or commercially exploit our protected materials without prior written permission, except where permitted by applicable law.Third-party trademarks remain the property of their respective owners.WhatsApp, Meta, Google, RCS and associated marks are the property of their respective owners. Nothing in these Terms grants Mahalaxmi Jewellers or its customers ownership of those marks.Where applicable, our use of third-party platform branding will follow the relevant brand guidelines and usage permissions.
13. ConfidentialityMahalaxmi Jewellers will take reasonable steps to protect confidential customer information.Customers should also avoid sending sensitive information through ordinary messaging channels unless specifically required and appropriately protected.Confidentiality obligations may not apply to information that:Is publicly available;Was already lawfully known;Is independently developed;Must be disclosed under law or a lawful governmental or judicial requirement;Is required to be shared with authorised service providers for providing requested services.
14. Disclaimer of WarrantiesMahalaxmi Jewellers will make reasonable efforts to maintain accurate information and reliable customer communication.However, digital communication services are dependent on third-party infrastructure, telecommunications networks, internet connectivity, device compatibility and external platforms.Accordingly, to the maximum extent permitted by applicable law, we do not warrant that our digital services will always be uninterrupted, error-free, continuously available or completely secure against every possible threat.Product-specific warranties, guarantees or statutory consumer rights will continue to apply where legally applicable and will not be excluded by these general Terms.Nothing in these Terms is intended to exclude a right or remedy that cannot lawfully be excluded under Indian law.
15. Limitation of LiabilityTo the maximum extent permitted by applicable law, Mahalaxmi Jewellers will not be liable for indirect, incidental, special, consequential or unforeseeable losses arising solely from the use or unavailability of third-party communication platforms.This includes delays caused by telecommunications networks, WhatsApp, Meta, Google, RCS providers, carriers, internet service providers or customer devices.Nothing in this clause limits liability where such limitation is prohibited by applicable Indian law, including liability that cannot legally be excluded or limited.Customers remain responsible for checking transaction details, payment instructions, product specifications and other information before completing a transaction.
16. IndemnificationTo the extent permitted by law, a customer agrees to indemnify and hold harmless Mahalaxmi Jewellers, its owners, employees and authorised representatives against reasonable losses, claims or expenses arising from the customer’s unlawful use of our services, fraud, intentional misconduct, unauthorised use of another person’s information or violation of these Terms.This clause does not require a customer to indemnify Mahalaxmi Jewellers for losses caused by Mahalaxmi Jewellers’ own unlawful conduct or liability that cannot legally be transferred to a customer.
17. Governing Law (India)These Terms are governed by the laws of India.Subject to applicable consumer-protection and other mandatory legal rights, disputes relating to these Terms or services provided by Mahalaxmi Jewellers shall be subject to the jurisdiction of the competent courts having jurisdiction over the business location in Maharashtra, India.Nothing in this section prevents a customer from exercising a mandatory statutory right available under applicable Indian law.
18. Changes to TermsMahalaxmi Jewellers may update these Terms from time to time to reflect changes in our services, applicable law, technology, security practices or third-party platform requirements.The updated version will be published on the relevant website or made available through an appropriate communication channel.Where a change materially affects customers, we may provide additional notice where appropriate.Continued use of our services after an updated version becomes effective may constitute acceptance of the revised Terms to the extent permitted by applicable law.
